Summary of Kimberling City Board of Aldermen Meeting- Nov. 2, 2021

During the November Kimberling City Board of Aldermen meeting, new Police Chief Todd Lemoine was sworn into office.
Next, financial reports were given followed by and reading of the bills and ordinances.
City Administrator Jerry Harman updated the Board of Aldermen on changes to section 420.020 Planning & Zoning Commission Membership Qualification. Mr. Harman spoke to the City Attorney who stated that the current City Ordinance does not meet state statute. Proposed changes will bring the City of Kimberling City into compliance with tate law.
Mayor Fritz asked for a motion to approve changes to section 420.020 Planning & Zoning Commission Member Qualifications to follow Missouri State Statute.
Alderwoman Stump made a motion to approve changes to section 420.020 Planning & Zoning Commission Membership Qualifications to follow Missouri State Statute.
Motion was seconded by Alderman Moore. Discussion followed
Alderman Martin commented that due to the changes being made the Planning & Zoning Commission did loose two members who did not meet the membership criteria.
Mayor Fritz has sent out applications so several citizens in Kimberling City and is actively trying to recruit new members as quickly as possible.
Motion carried with non voting naye.
Mr. Harman updated the Board of Aldermen on Ordinance 515 Unimproved Streets.
Currently in City Ordinance there is no guidance for unimproved streets. Mr. Harman and Mr. Reed spoke to the City Attorney to help create an ordinance to be implemented for unimproved streets within the city. Ordinance 515 adds the rules and guidelines for city responsibility pertaining to unimproved streets.
Mayor Fritz asked for a motion to approve the first reading of Ordinance 515 Unimproved Streets. This is the first reading, two are required.

Sewer Leak Adjustment- Wendt, 7 Pioneer Place
Deputy City Clerk Sara Fennema presented the sewer leak credit information for Mr. Wendt. Mr. Wendt has an average usage of 1,340 gallons ($11.50). During the
timeframe of the leak the September bill showed a total of 10,500 gallons used (92.82), and the October bill showed a total of 180,400 gallons used ($1594.74).
If approved, the sewer leak adjustment will be for a total of 188,220 gallons of usage breaking down to: September- 9,160-gallon adjustment totaling $80.97, October179,060-gallon adjustment totaling $1,582.89 showing a total credit of $1,663.86.
Alderwoman Stump made a motion to approve a sewer leak adjustment for Mr. Wendt at 7 Pioneer Place in the amount of $1,663.86.

Thomas Martin, Jeremiah Erickson Lot Split/Combination:
Mayor Fritz presented the Martin/Erickson lot split/combination to the Board of Aldermen. The lot split/combination request was present to the Planning & Zoning Commission at the October 2021 regular meeting. Mayor Fritz asked for a motion to pprove the Thomas Martin, Jeremiah Erickson lot split/combination pending signature notarization.

Alliance Water Resources 2022 Contract:
City Administrator Jerry Harman presented the Alliance Water Resources 2022 Contract to the Board of Aldermen. There were some changes made to the 2022 contract from previous years. Changes made were:
1. The contract has been changed from a five-year contract to a three-year contract with a two-year option.
2. Changing the set annual price increase to the CPI.
3. Verbiage added to say if there are three documented instances of mismanagement, negligence, or misconduct the contract can be terminated.
Mr. Harman asked for a motion to approve the 2022 Alliance Water Resources contract allowing Alliance Water Resources to maintain the City of Kimberling City Wastewater Treatment Plant for the next three years.
Alderwoman Stump made a motion to approve the 2022 Alliance Water Resources
Contract including all above referenced changes.

Report of Officers, Boards, and Committees
Economic Development, Alderwoman Stump: Economic Development Committee met
October 20th. City Administrator Harman presented the 2021 City Update to the Economic Development Committee. This presentation was presented at the October
Board of Alderman Meeting.
Park Board, Alderman Moore: The Park Board met October 26th. Park Board is still looking for volunteers for the Friends of Kimberling City Parks Board. The Board is working on sponsorship and donations forms to help start work on the Hilltop Park on Kimberling Blvd. Mr. Harman presented the 2021 City Update presentation.
Police Committee, Alderman Jacobs: The Police Committee did not meet in October.
Planning & Zoning, Alderman Martin: P & Z lost two members due to the new regulations on membership. The Thomas Martin lot split/combo was approved with a recommendation to present to the BOA. A rezoning request for a setback variance at 16 Cardinal Lane was approved and a public hearing will be help on November 17th. Mr. Harman presented the 2021 City Update Presentation.
City Clerk Update: Deputy City Clerk Fennema stated that the Halloween Trick or Treat event had about 125 kids come and was a success. The Annual Tree Lighting will be on November 20th at the Shopping Center and the City will be collecting food and toys gain this year. The donation box has been set up in the City Hall Lobby.
City Administrator Update: Lakeshore Bridge Repair: the engineering company is stating there is an estimated 60-90 days for completion. Bids still need to be sent out for the scope of work to be done. This is included in the 60 – 90 day completion estimate.
Kristina Lane issue: There is a parcel that is land locked and the only access point is through Kristina Lane. Citizens who live on Kristina Lane are complaining about trucks and load weight damaging the road. The City Attorney did say that the City would have to grant access through Kristina Lane, but an ordinance can be put into place to regulate truck wight to prevent damage. Mr. Harman and Mr. Reed will be working on the ordinance and presenting it to the Board of Aldermen for approval.
In the Public Works Department Gator German and Nick Carlson passed their CDL permits. Joe Smith and Randy Reed will be training them on use of the heavy equipment.
There will be a public hearing on November 17th, with a special meeting directly after.
Mr. Harman would like to schedule a budget meeting for December 1st.
Mayor: Annual Christmas Tree Lighting November 20th, 4:30-5:30 PM in the Shopping Center Parking Lot. December 4th at 10:00 AM is the Annual Christmas Parade. Chief of Police Meet and Greet, Wednesday, November 10th 4:30-6:30 PM in the Community Center.
The Board then went into closed session.
