State Rep. Brad Hudson Works
to Protect Campgrounds and Recreational Areas
from Frivolous Lawsuits

State Rep. Brad Hudson worked diligently during the 2021 legislative session to ensure campground operators can continue to offer their services to those who enjoy the outdoors without fear of frivolous lawsuits. This week Gov. Mike Parson signed into law HB 369, which contains language from Hudson’s HB 1070 to create liability protections for campground operators who conduct business in good faith.

Hudson’s provision protects operators from being sued for injuries or damages that occur as a result of the inherent risk of camping. The bill does not provide protections for campground operators who act with willful or wanton disregard for the safety of those who use their site, or who fail to use the degree of care that a prudent person would use.

Hudson said the bill will protect those who act in good faith from lawsuits that are based on accidents that occur as a result of being outside in a natural environment. The bill will not protect bad actors who fail to take the proper precautions to ensure a safe campground.

“I'm excited that Governor Parson has signed this legislation. Citizens should be able to conduct business without having to worry about their livelihood being destroyed because of needless litigation," Hudson, R-Cape Fair, said. There were a number of people who put a lot of work in to get this across the finish line. I am grateful to each one of them."

With the governor’s signature, the bill will now take effect as law on August 28.
