Sentences handed down in felony cases

Zackery Carey, 20, of Billings, was convicted on two separate charges, of felony stealing, in Stone County last week.
In the first case, Carey stole $2,000 in copper wire from a Crane business in the overnight hours of January 13, 2020. During the investigation, a vehicle at the scene matched the car that Carey was known to use. The vehicle owner told officers that Carey had access to the car the night Carey stole the wiring.
Later in the day, on January 13, a substantial amount of copper wire was sold. That sale also pointed to Carey as the suspect. The Crane Police Department investigated the case.
Carey’s second felony stealing charge resulted from the theft of a personal watercraft (PWC). The victim’s neighbor noticed that the victim’s PWC was missing from their boat dock on Table Rock Lake. Shortly after that, the neighbor also observed two men operating the PWC. The neighbor then contacted the owner, who said that no one had permission to use the boat.
At that time, the neighbor used his own boat and was able to film the two men. The men abandoned the boat and ran into the woods. A search of the woods by the Stone County Sheriff’s Department resulted in Carey’s capture and arrest.
Carey pled guilty to both charges. Stone County Assistant Prosecutor Gary Apfel prosecuted the cases. Circuit Judge Jack Goodman sentenced Carey to 7 years in the Missouri Department of Corrections on each case.
Kelly Bishop, 37, of Shell Knob, pled guilty to second-degree statutory sodomy for sexually touching a 15-year-old girl. The victim had spent time at a friend’s home during the summer in the Shell Knob area. She reported that during this time, she was touched by her friend’s father, Kelly Bishop.
During an interview with the Child Advocacy Center, the victim gave details of the crime and stated that the defendant’s wife had walked in and caught Bishop on one occasion. No one reported the crime at that time.
Deputy Brian Landreth of the Stone County sheriff’s office investigated the case. His investigation confirms the victim’s description of what happened. It included an interview with the Bishop in which he admitted to sexually touching the victim.
Due to the victim’s age, the maximum sentence under Missouri law is seven years. After pleading guilting, Circuit Judge Jack Goodman sentenced Bishop to 5 years in the Missouri Department of Corrections. Stone County Prosecuting Attorney Matt Selby prosecuted the case.
Jeremy Davis was sentenced to seven years incarceration in the Missouri Department of Corrections on a probation violation. Davis was initially found guilty to charges in 2017 of Endangering The Welfare Of A Child Creating Substantial Risk - 1st Degree - 2nd/Sub Offense - Sexual Conduct. Davis was originally sentenced to seven years in the Missouri Department of Corrections-suspended, 45 days shock credit for time served, five years supervised probation. Davis was required to register and be supervised as a registered sex offender.
According to public record, Davis had previously been cited with multiple probation violations, beginning within weeks of sentencing. Records show probation violations filed in July, August, October and November of 2018. Davis failed a urine drug test, which violated his probation in December of 2018, and was taken into custody. Records go on to show his probation was revoked on January 7, 2019. He was given 120 days of shock time, and in May 2019, Davis was sentenced to seven years in the department of corrections-suspended; five years supervised probation.
Probation violations were also filed in October, November and December 2019 and again on January 31 and July 22, 2020.
Javier Duran was sentenced to 3 years in the Missouri Department of Corrections on probation violations stemming from a Resisting Arrest charge in February 2019.
