Out of chances, four sentenced in Stone County Court ​

Several individuals who had been convicted of felony crimes and given an opportunity to make changes in their lives while on probation recently had those opportunities revoked and were sent to the Missouri Department of Corrections.

In December 2018, Matthew Hembree was charged with burglary and stealing after a neighbor observed and videotaped him and another person taking things from a home on Carrico Road in Stone County. The defendant, 25 years old at the time, pled guilty in July 2019 and was given a chance at probation but failed to pay restitution to the victims, did not report to his probation officer, and got new criminal charges. The Stone County prosecutor’s office
sought to have his probation revoked, and Circuit Judge David Cole agreed, revoked the defendant’s probation, and sentenced him to five years in prison.

Amanda Rodriquez, 32, originally pled guilty to possessing methamphetamine in 2021 and was given a chance to attend and complete the Stone County drug court program. She failed to comply with that opportunity and was placed in an institutional drug treatment program. After completing that program, she was again placed in drug court. She again failed to comply with the program’s requirements and was arrested for new criminal charges. Her probation was revoked at the request of the prosecutor’s office, and Judge Blankenship sentenced her to five years in prison.

On or about May 14, 2018, Alex Scheuerman was charged with two counts of felony domestic assault after punching his grandfather in the face and head multiple times and then striking his wife in the face, hitting her with a chain, and dragging her by her hair. The defendant pled guilty in September 2019 and, at the victims’ request so he could get him help, was given a chance at probation to get help with substance abuse and other problems. However, he failed to follow through, absconded from supervision for over six months, and continued to use illegal drugs. He also was charged with a new crime in another county while on probation. On January 4, 2022, his probation was revoked, and he was sentenced to five years in the Missouri Department of Corrections.

Zachary Rivera-Silva was charged with possessing methamphetamine on September 4, 2020. He pled guilty on June 8, 2021, and, after spending four months in prison in a treatment program, was given a chance at probation. After several probation violations, including new law violations, the prosecutor’s office sought to revoke the defendant’s probation. Judge Alan Blankenship agreed and sentenced the defendant to five years in the Missouri Department of Corrections.

Prosecutor Matt Selby said, “The majority of people charged with crimes get a chance at probation, to make positive changes, and to show the court that they will not continued to violate the law. Each of these cases are examples of people who were given multiple chances to show that they could be law-abiding, productive citizens, and failed when given the chance.”
